1.You acknowledge and agree that FXMessage:
a)is intended to be a place where OANDA's customers, employees, and other interested parties can share questions, suggestions, and information about OANDA and its products, foreign exchange trading and other related subjects;
b)is intend for discussion of business and technical issues; and
c)is not provided for the posting of commercial messages, chain letters, pyramid schemes, or solicitations of business.
2.In posting messages to FXMessage, you agree that you shall not post any message or material which is abusive, threatening, libelous, defamatory, obscene, pornographic, or that would violate any law. You agree not to post any message or material that may infringe upon or violate any third party's intellectual property rights, including, without limitation, copyright, patent, trademark, trade secret, moral right, proprietary rights or rights of publicity or privacy, or that contains any viruses or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information, or which is materially false, misleading or inaccurate.
3.You agree that you are solely responsible for any messgage or material you distribute, post, include or otherwise upload to FXMessage. You agree to indemnify and hold OANDA, its parent, subsidiaries, affiliates, directors, officers and employees, harmless from any claim, demand, or damage, including reasonable attorneys' fees, asserted by any third party or arising out of any message or material you post to FXMessage, or as a result of your use of, or conduct on, FXMessage.
4.You agree that you will not suggest, state, or imply that OANDA has reviewed, endorsed, approved or agrees with any message or material that you post or have posted to FXMessage.
5.You acknowledge that OANDA does not pre-screen messages or material posted to FXMessage. OANDA reserves the right, although it does not have the obligation, to monitor content on FXMessage and to remove any message or material you may post where OANDA in its sole discretion, determines such message or material to be harmful, offensive, defamatory, libelous, illegally threatening or harassing or which contains obscenity, pornography or is otherwise inflammatory; which may create liability for OANDA; or is unrelated to the intention of FXMessage or is otherwise in violation of law or OANDA's Web site terms of use.
6.By posting any message or material to FXMessage you hereby grant to OANDA a worldwide, perpetual, irrevocable, transferable, royalty-free, license (including the right to sublicense), to exercise all copyright and publicity rights, in any media now known or not currently known, with respect to any such message or material. You agree that OANDA may reveal your identity (and whatever information OANDA knows about you) in the event of a complaint or legal action arising from any message or material posted by you to FXMessage, or as otherwise required by law.
